I recently attended an excellent webinar hosted by Pinsent Masons LLP on the topic of “Internal Investigations after ECCTA “.

The UK ECCTA (Economic Crime and Corporate Transparency Act 2023) introduces a wide range of measures aimed and preventing and tackling corporate crime. But, interestingly, the Guidance issued under the Act raises the bar in terms of the standards expected of all internal investigations (and not just financial investigations).

UK regulators now expressly require internal investigations to be appropriately resourced, properly scoped and legally compliant, with internal investigators empowered, independent, and adequately trained. This Guidance echoes the US Department of Justice standards, which have been in place for some time. 

It is now clear that the expectations of regulators in respect of internal investigations are increasing across the globe and that companies must invest in the development of appropriate processes and standards for their investigations, and in the training of internal investigators.
